1. Who we are
Spottr is operated by Viridian Dynamics. Contact us at hello@viridiandynamics.com.au.
2. Your account
You are responsible for keeping your password secure. You must be old enough to enter a contract in your jurisdiction. One person, one account.
3. Testing period
Spottr is in testing. Every feature is available to every account at no cost during this period, including the ones listed in section 4 as paid. No payment method is required to create an account or to use anything, and nothing is charged automatically at any point.
This is a testing period and not a permanent offer. When it ends, some features will move behind the subscription in section 4. We will tell you before that happens, and you will never be charged without choosing to be: if you do nothing when the testing period ends, the account keeps working with fewer features rather than being locked or billed. Your training history stays yours either way, and the export in section 10 keeps working whatever tier you are on.
4. Subscription and billing
Nothing in this section is being charged during the testing period in section 3. It describes what a subscription will cost when there is one to buy.
Subscriptions are $5.00 per month or $50.00 per year, in AUD, and renew automatically until cancelled. Subscriptions are bought and paid for through the App Store or Google Play, not through us. They are the seller for that transaction, their terms apply to it, and we never see or store your card details.
You cancel in your App Store or Google Play account, not here. That is where the subscription lives, and it is the only place that can stop it. We will link you straight to the right screen from your account page. Cancelling stops future renewals and you keep access until the end of the period you have already paid for. We do not pro-rate partial periods.
Refunds are handled by whichever store you bought through, under their policy. We cannot issue one for a purchase we did not take, though tell us anyway if something has gone wrong and we will help you sort it out. None of this affects rights you have under the Australian Consumer Law or, in the UK and EU, your statutory rights, which cannot be excluded by these terms.
5. Price changes
If prices change we will tell you before the change affects you, and you can cancel before it does.
6. Affiliate program
Approved affiliates earn 5% of each payment made by a customer they referred, for up to 12 months per customer. Attribution is first-touch and lasts 30 days.
When commission clears:each commission is held until that customer's next payment succeeds, which is what confirms the earlier payment was not reversed. For a monthly subscriber that is roughly a month. For an annual subscriber the next payment is twelve months away, so the first commission clears then. If a customer stops subscribing, the outstanding held commission is not paid; commission that has already cleared remains yours.
Payouts are made by PayPal once cleared earnings reach $50.00. We may decline or end an affiliate arrangement, with a stated reason, where promotion is misleading, spam, or misrepresents the product.
8. Acceptable use
Do not attempt to breach the service's security, access other users' data, resell access, or use the service to break the law.
9. Coaching between users
When you ask somebody to coach you, you choose what to tell them. The Coaches and gyms section of our privacy policy sets out exactly what reaches them and when, including that your contact details are withheld until they accept and stop being visible if the arrangement ends.
If you are the coach: what you are given is for coaching that person and nothing else. Do not pass it on, do not add it to a mailing list, and do not keep using it after the relationship ends. Health information somebody trusts you with is held on the same terms you would hold it on outside this app, and your own professional and legal duties apply to it in full.
We are not the coach.Spottr introduces people and carries messages between them. The coaching itself, its quality, its safety, any qualification claimed, and any money that changes hands directly between you are between the two of you. A verified badge means we checked a business registration, not that we assessed anybody’s competence.
10. Your data
Your content remains yours. See our privacy policy for what we collect and how to have it deleted.
11. Availability and liability
We aim for the service to be available and correct but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, our liability is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes rights you have under consumer law that cannot be excluded.
12. Changes and governing law
We may update these terms; material changes come with notice and a new version number. These terms are governed by the laws of New South Wales, Australia.
